takpark — Terms of Service

These Terms of Service ("Terms") govern your use of the takpark mobile application ("App", "Service", "takpark"). By downloading and using the App, you accept these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

1. Description of the Service

takpark is an intermediary platform that matches drivers leaving a parking spot with drivers searching for one based on location. Once matched, users can communicate with each other via the in-app voice call feature.

takpark does not provide parking spaces, does not own them, and makes no warranty as to the availability, safety, legality, or accuracy of any parking spot brokered through the Service. Parking spot information is provided entirely by users.

2. Account Creation

• To use the App you must create an account via Apple Sign-In or Google Sign-In.
• You must be at least 13 years old to create an account.
• You are responsible for ensuring the information you provide (name, vehicle info, etc.) is accurate and up to date.
• A person may have only one active account.

3. Credit System

To prevent abuse, the Service operates on a credit system:

• New users start with 10 credits upon registration.
• Searching for a parking spot costs 1 credit per match request.
• A successful "leaving" transaction earns 1 credit.
• The credit system is tied to an email-based ledger, so deleting and recreating an account does not reset a credit deficit.
• Credits are not actual currency; they are non-transferable, non-saleable, non-refundable, and have no cash value.
• takpark reserves the right to adjust or reset the credit balance of any account it identifies as abusive.

4. Voice Calls

• Voice calls between matched users occur peer-to-peer via WebRTC.
• takpark does not listen to, record, or store voice call content.
• Harassment, threats, spam, or insults during calls are prohibited. You can report such incidents to takpark2020@gmail.com.

5. Acceptable Use

The following behaviors are prohibited:

• Accessing the Service or generating credits via automation, bots, or scripts.
• Creating fake accounts, impersonating others, or abusing the credit system via multiple accounts.
• Harassment, threats, discrimination, or spam targeting other users.
• Commercial use: selling parking spaces for profit, advertising, building a parking marketplace, etc.
• Manipulating location data (e.g., fake GPS) or generating fake matches.
• Probing the App's security, reverse engineering, or attempting to harm our infrastructure.
• Any use that violates the laws of the Republic of Türkiye or the jurisdiction in which you are located.

6. Account Termination

takpark reserves the right to suspend or terminate accounts without prior notice for violations of these Terms. If you believe your account was terminated in error, you may appeal at takpark2020@gmail.com.

You may delete your account at any time from within the App via Profile → "Delete Account".

7. Intellectual Property

The App's design, logo, brand name, source code, and content are owned by or licensed to takpark in their entirety. They may not be copied, used to create derivative works, or used commercially without written permission.

Content you create while using the App (e.g., vehicle information) belongs to you; you grant takpark only a limited license to use it for the purpose of providing the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available". takpark makes no warranties, express or implied, that the Service will be uninterrupted, error-free, or always accessible.

takpark is not responsible for:

• Whether a parking spot is actually vacant.
• Traffic fines, towing, or clamping resulting from parking in prohibited or illegal areas.
• Accidents, theft, vandalism, or material damages occurring during or after parking.
• Interactions between matched users, voice call content, or disputes.
• Outages or failures of third-party services (Firebase, Apple, Google, Google Maps).

9. Limitation of Liability

To the maximum extent permitted by applicable law, takpark's total liability for any direct, indirect, incidental, special, or consequential damages arising out of the Service is limited to the amount you have paid to takpark in the last 12 months (or zero if no such payment has been made).

10. Indemnification

You agree to indemnify takpark against all third-party claims, damages, and costs (including attorneys' fees) arising out of your violation of these Terms or applicable laws, or out of your conduct on the App.

11. Changes to the Terms

takpark may update these Terms from time to time. Material changes will be announced via in-app notification or email. Continuing to use the App after the updated Terms take effect constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Any dispute arising out of these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the Istanbul Courts and Enforcement Offices.

For users who qualify as consumers, this clause applies without prejudice to the consumer's right to apply to the consumer arbitration board or consumer courts in their place of residence.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
